The Court of Appeals affirmed the dismissal of the trial court, but rejected most of the defenses raised by the state. In its opinion, the court “assumed” the atmosphere is a public trust resource and gave the youth a blueprint for how to pursue their public trust claim.

Jaime Lynn Butler continues her fight to compel climate change action! The 11-year-old member of Navajo Nation filed an opening appeal brief in her appeal.

Hearing at the Maricopa County Courthouse for the State's Motion to Dismiss. At the hearing, the trial court granted the government’s motion to dismiss in one sentence without issuing an opinion in support of the decision. Jamie Lynn will appeal to the Arizona Court of Appeals.
